Illegal Building
The Office manages and prepares enforcement actions against illegal building and related offenses within the municipality, including enforcement actions against properties.
Skills
- It records the minutes of assessments and/or seizures, denials, requests, and various reports, identifies the various types of abuse on a case-by-case basis, and conducts the investigation for the adoption of the relevant measures.
- It oversees and drafts the repressive documents for illegal building as identified in Presidential Decree 06.06.2001 n. 380 (articles 27, 31, 33, 34 and 41) and subsequent amendments, such as demolition orders, suspension of works orders, imposition of administrative sanctions, and requests, when necessary, binding opinions from the Superintendency of Cultural Heritage and Activities of Messina, pursuant to art. 37 of Presidential Decree n° 380/01;
- Performs the electronic entry, updating, and compilation, through the new web interface application system with the Department of Land and Environment (SIAB), of all information relating to building violations and the subsequent compilation of the fortnightly lists, in compliance with the provisions of art. 13, paragraph 1, Regional Law 17/94.
- He manages relations with the local Traffic Police Command and the municipal legal office, keeping them constantly updated on the practices subject to legal appeals.
- Manages relationships with various institutional bodies, law enforcement agencies, and external agencies, such as the Regional Department of Land and Environment, the Prefecture, the Public Prosecutor's Office, the Court, the Regional Administrative Court, the Regional Administrative Court, the Regional Legislative and Legal Office, etc., regarding practices and documents relating to illegal building.
- Prepares monthly data for the Municipal Secretary regarding illegally constructed properties and works, which are the subject of reports from judicial police officers and agents and the related suspension orders, and ensures that these data are posted on the municipal noticeboard and transmitted to the Regional Department and the Public Prosecutor's Office, as required by Article 31, paragraph 7, of Presidential Decree 380/01.
- He participates in hearings at the court of Barcellona PG, by proxy, as legal representative of the Mayor as the injured party and in place of the UTC Head as a witness, in cases against defendants guilty of illegal construction.
- The office oversees the transcription of uncomplied ordinances, the transfer of ownership of acquired property to the municipal estate, the determination of external and/or internal assignments for subdivision (if necessary), the planning and management of demolition works, and council resolutions to verify the existence of prevailing public interests (including the possible transformation of the property into subsidized housing), provided that the work does not conflict with significant urban planning or environmental concerns.
- The service also provides the preparation of responses to requests from the Administration, to council questions, and clarifications to citizens regarding various types of requests.
